These Terms of Use (“Terms”) govern your use of NomadPad (the “app”). The app is distributed through the Apple App Store and is also subject to Apple’s standard End User License Agreement (the “Apple Standard EULA”), which forms the underlying license between you and the developer. These Terms supplement the Apple Standard EULA. If there is a conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA prevails to the extent of the conflict.
The Apple Standard EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula/.
1. Service
NomadPad consists of two components:
- NomadPadRemote, an iOS and iPadOS app distributed through the App Store.
- NomadPadServer, a separate macOS application distributed without charge through GitHub Releases.
The app allows an iPhone or iPad to remotely control a paired Mac running NomadPadServer over the same local Wi-Fi network. All communication between the two components happens directly over the local network. The developer does not operate any cloud service, relay server, or backend that handles user data.
System requirements:
- NomadPadRemote: iOS 17 or later
- NomadPadServer: macOS 13 or later
- Both devices on the same local network
- Accessibility permission granted to NomadPadServer on the Mac
2. License
You are granted a non-transferable, non-exclusive license to use the app for personal purposes. You agree not to:
- reverse-engineer, decompile, or disassemble the app beyond what is permitted by applicable law;
- transfer, redistribute, or sublicense the license; or
- modify the app or create derivative works.
3. Subscription
NomadPadRemote offers an auto-renewable subscription through Apple In-App Purchase.
- Title: NomadPad Pro (Monthly)
- Length of subscription: 1 month, automatically renewing
- Price: as displayed in the app at the time of purchase, billed in your local currency
- Free trial: 7 days for first-time subscribers, subject to eligibility determined by Apple
Billing and renewal:
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- The renewal price is the same as the previous period unless we notify you of a price change at least 30 days in advance through the app or by email.
4. Cancellation
You can manage and cancel the subscription at any time in your Apple Account settings (Settings → your name → Subscriptions on iPhone or iPad). Cancellation takes effect at the end of the current billing period. Access to paid features remains until that point.
5. Refunds
All purchases are processed by Apple. Refund eligibility, amounts, and timing are determined by Apple under Apple’s policies. The developer does not receive payment information and cannot issue refunds directly.
You can request a refund through Apple’s Report a Problem page or through your Apple Account.
Where the app is materially unable to function for an extended period due to a defect on the developer’s side, the developer will, on request, support your refund request to Apple.
6. Acceptable Use
You agree not to use NomadPad:
- in violation of applicable laws or regulations;
- to access, control, or interfere with computers or systems you do not own or do not have explicit permission to control; or
- to misuse accessibility, automation, or input-control features for unauthorized actions.
7. Service Availability and Discontinuation
The developer may modify, update, or discontinue features of the app at any time. The developer also reserves the right to discontinue the app or the subscription service.
If the developer decides to discontinue the subscription service:
- The developer will provide at least 60 days’ advance notice through the app, the support website, or by email where reasonably possible.
- New subscription sign-ups will be stopped on or before the announcement date.
- Existing active subscriptions will continue until the end of their current billing period.
- Where the developer cannot provide the full 60 days of notice due to circumstances outside the developer’s reasonable control, the developer will support refund requests to Apple covering the unused portion of the current billing period.
Because NomadPad operates only over your local network and does not rely on the developer’s servers, the app may continue to function on existing devices and operating system versions even after the subscription service is discontinued. The developer makes no representations about ongoing compatibility with future operating system versions in that scenario.
8. Bug Reports and Support
The developer operates as an independent developer and provides support on a reasonable-effort basis.
- Reports sent to support@r1ca18.dev will, in general, receive an initial response within five business days.
- Compatibility with new major releases of iOS, iPadOS, and macOS is treated as the highest priority for fixes.
- The timing of bug fixes depends on severity, reproducibility, and the developer’s other priorities.
- Where a defect on the developer’s side prevents the app from functioning for an extended period (for example, the app cannot launch or pair for more than seven consecutive days), the developer will support refund requests to Apple as described in Section 5.
The developer cannot guarantee specific resolution times or uninterrupted service.
9. Disclaimer
The app is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law. The developer does not warrant that the app will be uninterrupted, error-free, or compatible with all hardware or operating system configurations.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the developer is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app. In jurisdictions that do not allow the exclusion of certain damages, the developer’s aggregate liability is limited to the amount you paid for the subscription during the twelve months preceding the event giving rise to the claim.
11. Changes to These Terms
These Terms may be updated from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use of the app after the changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Japan, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the app will be subject to the exclusive jurisdiction of the Chiba District Court as the court of first instance, to the extent permitted by applicable law.
